Understanding Your Rights Under the ADA & Rehab Act
Feb 20, 2025Did you know that many medical conditions qualify as disabilities under the Americans with Disabilities Act (ADA) and the Rehabilitation Act? Some conditions are so likely to be considered disabilities that little to no legal analysis is required. Yet, countless federal employees remain unaware of their rights and protections.
What Conditions Qualify?
The Equal Employment Opportunity Commission (EEOC) has recognized several conditions as almost always qualifying as disabilities. These include:
- Diabetes – Limits endocrine function
- Epilepsy – Limits neurological function
- Major Depression, PTSD, OCD – Limit brain function
- Multiple Sclerosis, Muscular Dystrophy, Cerebral Palsy – Affect neurological function
- Cancer – Limits normal cell growth
This is not an exhaustive list. If your medical condition substantially limits a major life activity—such as working, walking, concentrating, or communicating—you may have protections under federal law.
Why This Matters
If you don’t know your rights, you can’t protect them. Many federal employees endure workplace struggles without realizing they are entitled to:
- Reasonable accommodations to help them perform their jobs effectively
- Protection from discrimination based on their medical condition
- Medical privacy rights that prevent improper handling of their health information
If your agency has denied your accommodation request, retaliated against you, or mishandled your medical information, it’s crucial to document everything and educate yourself on your rights. Seeking legal guidance can also be a vital step in protecting your federal career.
