Probationary Employees, Due Process, and the Power of MSPB

In a case that has sent ripples through the federal workforce, the Trump administration recently asked the Supreme Court to block a ruling requiring the rehiring of 16,000 federal workers—most of them probationary employees. The court case raises urgent questions about due process, executive authority, and the limits of agency power.

While these legal battles play out at the highest levels, the implications reach deep into the day-to-day lives of federal employees. Whether you're on probation, facing discipline, or working through a turbulent agency transition, one truth holds firm: your peace of mind and job security should not depend solely on any one court ruling.

Don't Let One Door Be Your Only Option

The judge in this case ruled that the Office of Personnel Management (OPM) overstepped its authority by coordinating mass terminations across agencies like the VA, Treasury, and Pentagon. Yet the administration argues that the executive branch holds that power—and that the case doesn’t even belong in federal court, but rather before the Merit Systems Protection Board (MSPB).

This is exactly why I advise every probationary employee to file with the MSPB in addition to pursuing court remedies when appropriate. Even if a favorable court ruling is overturned, an open MSPB case can continue. It’s not guaranteed protection—but it’s a powerful tool, especially if you raise the right legal claims early.

Mindfulness Means Proactive Protection

Mindfulness isn't just about breathing deeply (though it helps). It's about being awake to your legal environment and taking clear-eyed, compassionate action. In this moment of uncertainty, ask yourself:

  • Am I relying too much on one possible outcome?

  • Have I taken all the steps available to protect my rights?

  • Do I have the emotional tools and community support to navigate instability with resilience?

That’s where The Mindful Federal Employee Power Hub Membership comes in. It's designed to give you not just legal insights, but peace of mind. As a member, you’ll gain access to guidance, updates, and mindfulness tools to help you stay grounded—even when everything around you feels up in the air.

We may not all be directly affected by this case, but it speaks to something we all need: a federal workplace grounded in fairness and due process. Let’s protect that—and protect ourselves—mindfully.
