New OPM Regulations Could Threaten Your Appeal Rights

A critical update is unfolding that every federal employee should be aware of. Recently, The Federal News Network obtained drafts of the Office of Personnel Management’s (OPM) proposed regulations—and the implications are more serious than we first feared. These changes could drastically alter your rights and career stability, making it easier for agencies to remove employees without meaningful appeal options.

Why Should You Be Concerned?

Under the new rules, OPM would have unprecedented power to order the removal of federal employees based on expanded criteria. This includes:

  • Refusal to testify in internal investigations.

  • Accusations of mishandling government resources.

  • Failure to sign certain non-disclosure forms.

If OPM decides that removal is necessary, agencies would have only five days to execute the termination, leaving little room for employees to challenge the decision. This means the right to appeal through the Merit Systems Protection Board (MSPB)—a cornerstone of civil service protection—could be significantly weakened.

What’s at Stake?

These changes don’t just speed up the removal process. They risk politicizing federal jobs and undermining the basic fairness and stability that federal employees rely on. Without robust appeal rights, federal employees could be left vulnerable to wrongful removals and potential misuse of authority.
