Last week, the Trump administration filed a lawsuit in Waco, Texas, requesting court approval to exclude entire agencies from union protections. Their rationale? That union contracts are a threat to national security.

Under federal law (5 U.S.C. § 7103(b)), the President does have narrow authority to exclude agencies from collective bargaining—but only if strict criteria are met:

  1. The agency’s primary function must relate to national security, intelligence, or investigations.

  2. The government must show that union agreements cannot be carried out in a way that’s consistent with national security.

In this case, the administration argues that union protections—such as requiring performance improvement plans—slow down agency actions. But this isn’t enough. The statute demands more than general inconvenience. It requires proof that union procedures make it impossible to meet national security needs.

So why file this case with a single judge in Waco, Texas? That choice, too, raises questions. If the legal argument were truly robust, would such a targeted venue be necessary?
