OPM recently released a memo that could undermine collective bargaining agreements, allowing agencies to bypass traditional layoff negotiations. This means agencies may have more power to determine who stays and who goes, with less union intervention.
Some agencies have already started submitting RIF plans, with cuts expected as early as May. The IRS alone has let go of over 12,000 employees, with more layoffs expected across multiple agencies.
Adding to the challenge, OPM now requires unions to prove a "particularized need" before they can even challenge these layoffs—an extremely high legal hurdle. This move could be contested in court, but by the time that happens, many jobs may already be lost.
