But in practice, it’s doing much more—cutting federal jobs, taking control of agencies, and accessing sensitive internal data. And it’s all being directed by a private citizen who still leads powerful corporations.
Why This Matters for Federal Employees
Under the Constitution, only lawfully appointed officials can run federal agencies. That means either Senate-confirmed leadership or a narrow legal exception. Elon Musk doesn’t meet either requirement. In fact, at least one federal judge has already ruled his role in DOGE is unconstitutional—and ordered certain DOGE actions reversed.
This isn’t just a legal debate. It’s a human one. Federal employees are reporting sudden firings, unauthorized access to agency facilities, and disruptions to mission-critical work. Some DOGE teams have reportedly arrived with federal agents in tow, demanding control of offices like the U.S. Institute of Peace and the African Development Foundation.
